Terms of use
Last updated: 23 October 2026
The main points
- AnInvite.To is a tool for invitations. You are the organiser: you alone are responsible for your event, your content and your guest list.
- The service is provided as it is. We don’t guarantee that it is always available and free of errors, or that every email and notification arrives.
- We are liable only for intent and gross negligence. Any other liability, including for our auxiliaries, is excluded as far as the law allows (section 8).
- If someone makes a claim against us because of your event, your content or your guest list, you hold us harmless (section 9).
- Money between guests goes directly from person to person. AnInvite.To holds, checks and refunds no money.
- Swiss law applies. The German version is binding.
1. Scope and provider
These terms govern the use of AnInvite.To (the “service”), run by [COMPANY NAME], [ADDRESS], Switzerland (“we”). They apply to everyone who uses the service to create an event, a date poll or a party series, uses a host account or helps organise an event (“host” or “you”).
You accept the terms by ticking the box when you create something. If you act for a company or organisation, you confirm that you may do so; the terms then bind it too. Other terms of the host do not apply.
For guests who only answer an invitation, the privacy notice applies; section 7 (forbidden use) applies to them accordingly.
2. What the service is, and what it isn’t
The service helps you invite people, collect answers and organise things around an event. We don’t organise any event, we are neither organiser nor agent, and we don’t become a party to any agreement between you and your guests, venues, suppliers or anyone else.
The service is currently free. Paid offers will also have the terms shown when you order them.
3. Availability, no warranty
The service is provided “as is” and “as available”. As far as the law allows, we give no warranty that it works at all times, without interruption, securely and without errors, that emails, push notifications, reminders, calendar and wallet entries arrive or arrive on time, or that counts, lists, seating plans, check-in, exports and translations are correct and complete.
We may change, limit, interrupt (for example for maintenance) or end the service or any part of it at any time.
Check important details yourself and keep your own copy (for example the CSV export of the guest list). Events and data are deleted automatically after the periods in the privacy notice. We owe you no backup.
4. Your responsibility as host
- Your event: running it, safety, permits, noise, alcohol and youth protection, insurance, capacity, accessibility, changes and cancellations are yours alone.
- Your content: you are responsible for all texts, images, links, questions, wish and bring lists, messages and anything else you or your team enter, and for it being correct and lawful.
- Your guest list: you invite only people who may expect an invitation from you, and you handle their data lawfully. You are the controller of your guests’ data; we process it on your behalf and only for the service.
- Your links: whoever has your private host link can manage the event completely. Don’t pass it on, and renew it if it gets into the wrong hands. You are responsible for what happens through your links and for the co-hosts and reps you add.
- The law: you comply with all applicable laws when you use the service, in particular on data protection, marketing and unfair competition.
5. Money, presents and bring lists
When guests take on a present, chip in for one or bring something, they pay and deliver directly among themselves (for example by TWINT or bank transfer). AnInvite.To receives, holds, transfers, checks and refunds no money and is not a party to these arrangements. We take no responsibility for payments, refunds, fraud, taxes, things not delivered or disputes between those involved.
6. Public events, party series and profiles
If you make something public, you also confirm that the details are correct and current and that the event is lawful. We may review public content, not show it or stop showing it, and remove it, without giving reasons. We have no duty to review it and take no responsibility for hosts’ public content.
7. Forbidden use
- unwanted bulk email (spam), marketing to people who haven’t agreed to it, or invitations to bought or harvested addresses;
- unlawful, insulting, discriminatory, hateful, violence-glorifying, pornographic or content harmful to minors;
- content that infringes the rights of others (copyright, trademarks, personality or data protection rights);
- fraud, phishing, malware, pretending to be someone else, or faking an event;
- getting around limits and security measures, overloading the service, automated access without our permission, and reading out other people’s data;
- asking for more sensitive data (for example health or religion) than the event needs.
If you break these terms, or we have good reason to think so, we may remove content, hold emails, block or delete events, block access and inform the authorities, without notice and without compensation.
8. Liability
We are liable only for damage we cause intentionally or through gross negligence. Any further liability, in particular for slight negligence, is excluded as far as the law allows. Liability for auxiliaries (art. 101 Swiss Code of Obligations) is fully excluded as far as the law allows.
As far as the law allows, this excludes in particular liability for indirect and consequential damage, lost profit, lost data, messages not delivered, delivered wrongly or late, wrong counts or lists, events that fail, are disrupted or overbooked, costs of venue, catering or travel, acts of guests, co-hosts and other third parties, outages of third-party services (hosting, email, push services, Google Wallet), force majeure and attacks on the service.
Where mandatory law does not allow liability to be excluded, it is limited, as far as allowed, to the amounts you paid us in the twelve months before the event causing the damage, and to CHF 100 at most. Mandatory statutory liability, for example under the Product Liability Act, remains unaffected.
9. Holding us harmless
You hold us, our officers, employees and auxiliaries harmless from all claims of third parties (for example guests, venues, rights holders, authorities) arising from your event, your content, your guest list, your use of the service or a breach of these terms or of the law, including reasonable legal and court costs, as far as the law allows. You help us defend against such claims.
10. Rights to your content
Your content stays yours. You give us the simple, free right to store, process, show and send it to run the service, and for public content also in search, previews and for search engines. You confirm that you have the rights needed for your content, in particular for images.
11. Data protection
How we handle data is in the privacy notice. For your guests’ data, we process it on your behalf (art. 9 Swiss FADP, art. 28 GDPR), only to provide the service, according to your settings and with appropriate security; sub-processors are named in the privacy notice. You inform your guests where needed.
12. Term and ending
You can delete events and your account at any time. We can end the service for you or for everyone; except for breaches, we announce this reasonably in advance where possible. Sections 5, 8, 9 and 14 continue to apply after the end.
13. Changes to these terms
We may change these terms. The new version applies to events created afterwards. For existing events we ask for your agreement in the host area; if you keep using the service after that notice, the new version counts as accepted. If you don’t agree, you can delete your events.
14. Final provisions
Swiss law applies, excluding its conflict-of-law rules and the UN Convention on the International Sale of Goods. The place of jurisdiction is [COMPANY SEAT], Switzerland. Mandatory places of jurisdiction, in particular for consumers, remain reserved.
If a provision is wholly or partly invalid, the rest remains valid; it is replaced by a valid rule that comes closest to its purpose. An exclusion of liability applies to the extent it is allowed.
These terms exist in German, English, French, Italian and Serbian. If they differ, the German version is binding. Contact: [CONTACT EMAIL].
